Understand the diagnosis

VA claims can take a long time, which is especially hard for veterans facing a serious diagnosis. The VA offers priority processing for certain situations, including terminal illness and very advanced age. Asking for this handling, and supporting the request with medical evidence, can shorten the wait considerably.

Who can ask for priority handling

The VA gives priority to certain claims, including those involving terminal illness, veterans of very advanced age, serious financial hardship, homelessness and some other circumstances. A mesothelioma diagnosis may qualify, depending on the medical situation and prognosis. The key is making sure the VA actually knows about the condition and the reason priority is needed. Simply filing the claim is not always enough, because the priority status has to be identified and noted on the claim in VA systems. An accredited service officer can explain which priority categories apply to you and how to request them properly.

Supporting the request

Medical documentation makes a priority request much stronger. A letter or records from the treating doctor describing the diagnosis, the current condition and the expected course can help the VA identify the claim as urgent. Mark the claim clearly and include those medical records with the initial filing whenever possible, rather than sending them later. If the claim was already filed without a priority request, the veteran or representative can contact the VA and ask that it be flagged. Keep notes of who you spoke with, the date and what you were told, in case follow-up is needed.

Keeping the claim moving

Even with priority status, delays can happen if evidence is missing or an examination cannot be scheduled. Respond quickly to any VA requests and let the VA know if treatment makes it difficult to attend an examination. Some examinations can be arranged based on records, or scheduled around treatment. Your service officer can check the claim's progress and escalate concerns when appropriate. Families should also make sure a trusted person knows how to reach the VA representative if the veteran becomes too ill to follow up.

What to do next

  1. 1

Ask your doctor for a letter describing your diagnosis and current condition.

  2. 2

Request priority processing when you file and include the supporting medical records.

  3. 3

Have your service officer confirm the claim is flagged as a priority in VA systems.

  4. 4

Respond to VA requests quickly and tell the VA if treatment conflicts with an exam.
